Westlake Village (CA) - The United States Patent and Trademark Office has released their top ten patent filers for 2005. For the last 13 years, IBM has held the top spot and continues lead the way with 2941 patents granted. IBM files over 1000 patents more than Canon Kabushiki Kaisha in second place. Five Japanese, four US and one Korean company make up the list.

IBM recently joined forces with the Open Source community and the US Patent Office to help evaluate upcoming applications. Patent examiners will be given all prior art code when looking at future patents that involve open source. Under Secretary of Commerce for Intellectual Property Jon Dudas said, "It is important that those in the open source community are joining USPTO to provide resources that are key to examining software-related applications."

IBM’s patent bonanza was slightly less than 2004’s haul of 3248 patents. In a press release IBM’s senior vice president of Technology and Intellectual Property Dr. John E. Kely III said, "IBM believes that patents should be granted only for ideas that embody genuine scientific progress and technological innovation.

Samsung, the only Korean company in the list, edged out Intel and grabbed fifth place with 1641 patents.
