Napster spared, temporarily
Nine hours before Napster was to have been shut down, two 9th U.S. Circuit Court of Appeals judges wrote that "having raised substantial questions of first impression going to both the merits and the form of the injunction, the emergency motions for stay and to expedite the appeal are granted." Napster was orded to file a legal brief by August 18. The recording industry will respond by September 8 and the court will then schedule oral arguments.
