Microsoft appeals partition
Microsoft Corp.'s first filing with the U.S. Court of Appeals for the District of Columbia charges that US District Judge Thomas Penfield Jackson destroyed his own judicial impartiality by making repeated public statements critical of Microsoft. The Redmond company asked the appellate court to overturn Jackson's order and, if a new trial is convened, that Jackson be barred from participating. According to the filing, Microsoft's inclusion of its browser with Windows was a competitive response to Netscape Communications that "produced enormous consumer benefits." The government case will be delivered to the appeals court on January 12.
