Kazaa Federal Court Arguments Continue

The U.S. District Federal Court Judge hearing the case for summary judgment against Sharman Networks, parent of file-swapping music service Kazaa, will listen to further arguments from both the Recording Industry Association of America (RIAA) and from Sharman. Both Sharman and RIAA want the summary judgment motion concluded by the Judge without a full trial. RIAA and the copyright holders also want the Judge to order Kazaa to be shut down immediately, while Sharman contends that there is not a sufficient legal business nexus within the U.S. to subject Sharman to litigation in the United States in the first place. If Sharman's 'insufficient Nexus' argument prevails, this could make moot the case for shutting down Kazaa's file-swapping music service.
