Judge warns of Rambus embarrassment

Court transcripts show that Federal Judge Robert Payne has warned that Rambus Inc. may face "a great embarrassment" lacking a legitimate case in its SDRAM patent infringement trial against Infineon Technologies AG. A separate transcript shows that Payne accepted most of Infineon's arguments concerning allegations that Rambus fraudulently failed to disclose its SRDAM patent applications to the JEDEC standards body deliberating SDRAM standards while the company belonged to the organization.

Payne said, "there is evidence from which a jury could conclude that as early as 1992 Rambus was interested in stunting the adoption of the SDRAM standard." The transcripts also show that he raised the possibility that a Rambus disclosure in 1993 to JEDEC on a type of clock frequency, "was done for the purpose of deflecting attention from what was actually happening in Rambus' patenting process."

The trial is scheduled for April 17 in the federal district court in Richmond, Virginia.
