Gateway wins appeal of ITC patent decision in favour of HP
The International Trade Commission (ITC) today overturned an earlier decision that Gateway-branded PCs infringed on Hewlett-Packard (HP) patents involving parallel port technology. Winning the appeal, Gateway said will continue its battle against HP in front of an administrative law judge to which the case was remanded by the ITC.
HP had filed the patent infringement claim in 2004, claiming that Gateway’s PC infringed on a total of seven patents. According to Gateway, three infringement claims were dismissed prior to trial ; two additional claims were dropped during trial. The last standing claim was overturned this week.
At present, Gateway and HP are engaged in intellectual property litigation procedures in five different courts in the US. So far, HP has not commented on the most recent ruling.
