My new build is running warmer than I would like. motherboard socket is amd3. Under torture it runs in the 60's and this is while the computer is sitting on top of my desk which it will eventually be inside the cabinet. I planned to get a 212+ but measured and my case doesnt have room for it. I want a cooler that will fit and keep my CPU at a reasonable temp will in a cabinet. Any advice on one for $40 or less that will do the job?

You didn't say what case you own so it is difficult to guess at what would work but this zalman seems to be a lower profile unit. hope this helps.

I really don't understand how a 212+ which is 158.5mm tall won't fit in a 8.7" wide case.
I don't see a problem even with the two side panel fans which are mounted low enough as to not interfere with cpu coolers.

from the motherboard tray to the edge of the side fan ( I changed the location from the default to have a fan blow on the motherboard) measures 6" which is only ~152mm. Even if I were to relocate the fan, which I would prefer not to do if there is a comparable heatsink, I would gain roughly 25mm. I don't want the tops of the pipes to come close to contact with the case panel.

Well the Zalman Flex and Performa are 152mm tall units that support 2 120mm fans.
If those aren't appealing i would look at the Scythe Shurikens.
The Tuniq 120 Extreme is very good and 150mm tall.
