I thought I had bought 2GB of PC-6400 CAS4, I plugged it in and forgot about it.

However, looking at it with CPU-Z reveals 2 separate settings for 400MHz. One is CAS5 and the other is CAS4 but requires 2.1V.

My BIOS/system operates it at the CAS5 setting and am not quite so sure how to tell it to use it at the faster setting. The motherboard is MSI MS-7369 (nForce 560 chipset).

The memory in question is Corsair CM2X1024-6400C4

Is that a bit of a cheat or is my BIOS simply stupid?

you need to set it in BIOS. In order to work at CAS 4 you need to bump up the RAM voltage into 2.1v.

BIOS set it at CAS 5 because mainboard default voltage for DDR RAM is 1.8v.
